PAIA Manual

This Manual is published in terms of Section 51 of the Promotion of Access to Information Act, 2000 (Act No. 2 of 2000) ("PAIA") and is available for inspection at the offices of RecruitSA. This Manual also addresses the requirements of the Protection of Personal Information Act, 2013 (Act No. 4 of 2013) ("POPIA").

2. Guide on How to Use PAIA

The Information Regulator has compiled a guide in terms of Section 10 of PAIA, which contains information to assist in the exercise of rights under PAIA. The guide is available on the Information Regulator's website at https://inforegulator.org.za or can be requested from:

3. Records Held by RecruitSA

RecruitSA maintains records in the following categories:

3.1 Personnel Records

  • Employee personal files
  • Employment contracts

  • Leave records

3.2 Customer/Client Records

  • Agency account details
  • Subscription and billing records
  • Service agreements
  • Communication records

3.3 Candidate Records

  • Candidate personal information (CVs, contact details)
  • Application records
  • POPIA consent records
  • Interview notes and scorecards
  • Offer records

3.4 Operational Records

  • Financial records
  • Tax records
  • IT system records
  • Policies and procedures
  • Contracts with service providers

4. Request Procedure

To request access to records under PAIA:

  • Complete the prescribed PAIA request form (Form 2, available from the Information Regulator)
  • Submit the form to the Information Officer at paia@recruitsa.co.za
  • Pay the prescribed request fee (R50.00 for personal requests, R100.00 for other requests)
  • Provide proof of identity (copy of ID document)

We will respond to your request within 30 days of receipt. If the request is denied, reasons will be provided.

5. Grounds for Refusal

Access may be refused on the following grounds as per PAIA:

  • Protection of personal information of third parties (Section 34)
  • Protection of commercial information (Section 36)
  • Protection of confidential information (Section 37)
  • Safety of individuals (Section 38)
  • Privileged information (Section 39)

6. POPIA Compliance

In accordance with POPIA, RecruitSA:

  • Processes personal information only with lawful basis and consent
  • Maintains records of all consent given and withdrawn
  • Retains personal information only for the periods specified in our Privacy Policy
  • Implements appropriate security safeguards
  • Allows data subjects to exercise their rights (access, correction, deletion, objection)
  • Will notify affected parties of any security breaches within 72 hours
